Jackson County prosecutors on Monday accused a 23-year-old man of fatally shooting a rival who was walking along St. John Avenue in Kansas City last month.
Prosecutors charged Dustin D. Jones of Kansas City with second-degree murder and armed criminal action in the death of Donald Maxey, 22.
Police were called to the shooting at St. John and Topping avenues about 10:30 p.m. June 21, where they found a bloody tennis shoe but no victim. Police later stopped a car with a wounded Maxey inside. His brother was trying to take him to a hospital. An ambulance finished taking Maxey to the hospital, where he died.
Witnesses told police the gunman stepped out of a black Ford pickup truck and shot Maxey. Three days after the shooting, officers tried to stop a truck matching the description, but the truck sped away. Police later found it abandoned and linked it to a friend of Jones, who told police he had given Jones a ride the night of the shooting, according to court records.
Jones spotted Maxey walking and asked his friend to make a U-turn, the records said. Jones and Maxey argued before Maxey was shot. Jones told police that Maxey and several others had beaten him a few days before the shooting, according to court records.
